DEPOSIT, PAYMENT AND CANCELLATION POLICY
PAYMENT POLICY
Individuals : 25% of the cruise rate is due within 14 days of the reservation. Final payment is due ninety (90) days prior to
departure date.
Groups (half yacht or more): A non-refundable, non-transferable deposit of 10% within 14 days of the reservation.Six (6) months prior to departure, additional 40% of the charter funds are due. Final payment is due ninety
(90) days prior to departure date.

We accept all major Credit Card Payments. Terms and conditions as below:
Trip Payment (before your trip): we accept online credit card payment through STRIPE. Upon request, we will send you an online invoice that clearly show the Ombak Biru logo. Upon clicking on the link included in that invoice, you will be redirected to STRIPE secure server to complete the transaction.
Payment can be made via bank transfer or via STRIPE for credit card with a extra charge of 3.9%.

Failure t fulfil payment schedule stipulated within invoice gives Ombak Biru the right to cancel the trip with our refund go all existing payment.

CANCELLATION POLICY
Individuals: If a cancellation is made:
1. 181 days or more prior to departure, US$500 of the cruise rate is forfeited.
2. 180 – 91 days prior to departure, 40% of the charter rate is forfeited.
3. 90 days or less prior to departure, 100% of the charter rate is forfeited and no refund is available.

Groups (half yacht or more): If an entire charter is cancelled:
1. No cancellations allowed.

1. ADD ON payments onboard
All fees (Port Charges, Chamber Support, Park Fees, Local Taxes, Fuel Surcharges etc.) itemized separately are subject to change or may be added in any destination up until the date of travel.Onboard payments will be subject to 10% govt VAT and and extra 3.5% credit card charges.
We accept all major currencies with reference to XE.com rate with additional 0.06.
2. Guaranteed single accommodations will be charged a 65% supplement rate and are subject to DOUBLE the deposit
amount.
3. All guests must complete the Cruise Application and Waiver Agreement. Passengers who fail to submit these documents will have their reservation cancelled and be denied boarding.
4. Your charter price is locked in upon receipt of the Deposit and Cruise Application and will not change unless the
reservation is changed.
5. No refunds will be issued for unused or partially used packages.
6. We strongly recommend that each guest purchases comprehensive accident, medical, baggage and trip
cancellation/interruption insurance when space is reserved. Please be advised that if a guest chooses NOT to purchase
Trip Insurance, we will NOT BE RESPONSIBLE FOR ANY FINANCIAL DISAPPOINTMENT CAUSED BY REASONS
BEYOND OUR CONTROL. In the event that the it is necessary for Ombak Biru to cancel or interrupt a charter due to
weather or any “Act of God” which is beyond our control, there will be no refund or credit issued. We also recommend
diving accident insurance. Please inquire with our reservation office for assistance.

ALTERATIONS
All alterations must be made official via email.

Change of date:
Individual Booking:
91 days or above before departure: he company will apply all payment made to date to the agreed new date. However, the new trip will be subjected to price difference (as per our published rate above) and the promotion / discount granted from the original trip are not transferable.
90 days or less before departure: NO changes allowed.

Group Booking of more than 4 / Full Boat Charter (12pax or above): No changes are allowed.

Any other alteration(s) made 180 days or less before the departure date will be subjected to a 20% administration fee.

Alteration by us
If you would like to alter your reservation before payment of the Deposit you may do so subject to our consent & such consent may be subject to additional terms, conditions & charges
We reserve the right to change itineraries, schedules & Cruise Embarkation Dates at any time after payment of the Deposit, including at the last minute, should unforeseen circumstances arise. Such circumstances might include, but are not limited to, Force Majeure and other unforeseeable or unavoidable acts that might have the consequence of the vessel or passengers or crew being in harm’s way or danger.
If we change an itinerary, schedule or Cruise Embarkation Date we will endeavour to seek an alternative itinerary of comparable standard. You will be promptly informed of such alterations & you will not be entitled to cancel your reservation, withhold any payment due to us or seek Ombak Biru reserves the right to alter the itinerary or given services due to unforeseen or unavoidable circumstances.

Cancellation by Ombak Biru:
Ombak Biru will promptly notify the agent and/or client of any changes and will endeavor to arrange suitable alternatives if possible. In the unlikely event that Ombak Biru cancels a trip, an alternative date will be proposed. If this date is not acceptable, a refund will be considered for the amount paid.

(Unavoidable Circumstances):
“Unavoidable circumstances” refer to events such as weather conditions, unforeseen natural phenomena, Force Majeure (natural disasters, epidemics, etc.), and unavoidable acts of man (war, riots, etc.). Ombak Biru reserves the right to cancel a trip due to such circumstances and will inform the agent and/or client as soon as possible. Ombak Biru may cancel the trip without offering an alternative or refund. In such cases, agents/guests will be advised to seek compensation through their insurance, with Ombak Biru providing necessary documentation for the claim process.​

INSURANCE
It is strongly recommended that you take out travel (“cancel for any reason insurance”) & medical insurance suitable for your needs & personal circumstances (which should include Dive Package cancellation for any reason, flight cancellation for any reason, changes to itinerary, lost luggage, medical insurance, evacuation & repatriation & other usual holiday insurance terms) prior to your Embarkation Date. You acknowledge the importance of such insurance in respect of yourself & everyone in your party and you accept responsibility for assessing your own personal circumstances that you personally deem to be necessary. If you are an Agent you acknowledge the importance of such insurance for your Guests and you accept responsibility for advising your Guests obtain such.
It is required by Indonesia law that you must have current diving and medical evacuation insurance to board & you are required to give us proof that you have diving & medical evacuation insurance prior to the Embarkation Date. If you or your Guest(s) fail to provide proper valid evidence of current diving & medical insurance & evidence of their diving qualification certification prior to the Embarkation Date boarding will be denied.

SUPPLEMENTARY CHARGES
If the price per litre of diesel rises above Rp 16,000 we reserve the right to add such supplemental charge as we deem fair & appropriate
OTHER SUPPLEMENTARY CHARGES
We reserve the right to add other supplemental charges such as government levies, taxes, charges, port fees, national park entry fees & any other operating cost imposed on us & our operation of the vessel Ombak Biru by circumstances out of our control 90 days before the Embarkation Date unless such supplemental charge is notified to us less than 90 days before the Embarcation Date in which case we will notify you within 7 days of us becoming aware of such supplemental charge & you are liable to pay such supplemental charge within 7 days of our notification to you of the supplemental charge.

CRUISE SCHEDULE INTERRUPPTIONS
We are not liable to refund any money to you if you or any other guest interrupt or call short a Cruise schedule in the case of an emergency arising during the Cruise. In the case of an emergency affecting You we will endeavour to assist you in necessary arrangements for your return travel but You are responsible for payment of all costs & expenses connected with such repatriation & we strongly recommend that you purchase holiday interruption insurance (“cancel for any reason insurance”).

DISABILITIES AND BEHAVIOUR
By paying the Deposit you certify that you do not have any mental, physical or other condition or disability that could create a hazard for you or other passengers on board Ombak Biru. We reserve the right to require you to leave Ombak Biru immediately if you cause danger or disruption to the orderly management of Ombak Biru or cause significant offence or disturbance to other Guests or crew on board Ombak Biru or breach any law .

REPRESENTATION & PROMOTIONAL MATERIALS ETC
All representations contained in any information published by us relating to the Dive Package (other than these terms and conditions) do not form part of the contract between us and you and are hereby expressly excluded. The terms and conditions of the contract between us & you are exclusively set out in these terms and conditions.
PASSPORTS, VISAS, VACCINATIONS ETC
You must be in possession of a valid passport with not less than 6 months before expiration and all visas, permits and certificates required for the entire duration of the Dive Package & any other holiday you take in conjunction with the Dive Package. It is also recommended that you arrange whatever vaccinations are normally recommended for Indonesia by your doctor or other medical advisor and if you choose not to be vaccinated then we will not accept any liability arising from injury, death or other losses arising from failure by you to vaccinate yourself.
Any information given by us about visas, healthcare, vaccinations, climate, clothing, baggage, travel, hotels, special equipment and other matters is given in good faith but without liability to us.
TOUR GROUPS, LEADERS, CHARTERERS, AGENTS, REPRESENTATIVE, STAFFS ETC
If you have any directors, shareholders, employees, tour group leaders, representatives or consultants (hereafter called “Representatives”) accompanying your Guest(s) on board Ombak Biru the following conditions shall apply to all of them:
each Representative will complete & sign a Cruise Application Form & Release of Liability & Assumption of Risk Form & provide it to us. each Representative shall observe & perform these terms & conditions,
each Representative will follow the rules & regulations of Ombak Biru & the orders & directions of the Captain & Cruise Director of Ombak Biru each Representative will not teach or conduct scuba diving, free diving or snorkeling courses without our prior written permission
each Representative will not request changes to itinerary, meal times, dive schedules unless discussed with the Cruise Director & the decision of the Cruise Director shall be final
each Representative will not try to persuade other guests on board to make future bookings or reservations through your services on any liveaboard dive boat

INVALIDITY OF PROVISION FOR THIS AGREEMENT
You understand and agree that, in the event that one or more of the provisions of this agreement, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision hereof, and this agreement shall be construed as if such invalid or unenforceable provision had never been contained herein.

AGREEMENT
You agree you have read these terms and conditions set forth above in their entirety and understand them and accept them unconditionally. You further agree to observe strictly and comply with any additional reasonable terms and regulations as we may from time to time deem desirable or needful or prescribe during the course of the Cruise.

VARIATIONS TO THIS AGREEMENT
We can update, vary, amend & replace the terms & conditions of this Agreement from time to time & such update, variation, amendment& replacement will be available for viewing on our website www.ombakbiru
.com. You will be bound to observe & such updates, variations, amendments & replacements from the date they are published on our website www.ombakbiru.com
LAW
The law of Singapore applies to the terms & conditions in so far as they apply to OBE, its directors, shareholders, officers, employees, contractors & agents.
The law of Indonesia applies to the terms & conditions in so far as they apply to PTOB (which owns the vessel Ombak Biru), its directors, shareholders, officers, employees, contractors & agents.
